Natures Wisdom Terms and Conditions

Welcome to the Natures Wisdom website (the “Website”).  Natures Wisdom Limited (CRN 5387223) (“Natures Wisdom”) whose registered office address is situated at Ground Floor, Laser House, 132-140 Goswell Road, London EC1V 7DY provides the services available on the Website to you on the following terms and conditions (“the Terms”).  By accessing or using the Website you acknowledge that you have read, understand and agree, without limitation or qualification to be bound by the Terms. If you do not agree to the Terms you may not use the Website.

Natures Wisdom reserves the right to change the Terms at anytime.  Any such changes will be posted on the Website and shall be effective immediately upon being posted on the Website.  Your continued use of the Website constitutes your agreement to be bound by such changes.  In the case of any violation of the Terms, Natures Wisdom reserves the right to suspend or terminate your access to the Website.

Eligibility to order products

To be eligible to purchase products on the Website you must

1. register on the Website;
2. be the holder of a valid credit/debit card;
3. be purchasing the products for personal use only. (You may not sell or resell any of the products that you purchase on the Website unless you have an agreement with Natures Wisdom to do so).  Natures Wisdom reserves the right to decline any order that it has reasonable cause to believe is for onward sale other than through distribution channels approved by Natures Wisdom.

Product Descriptions

Natures Wisdom attempts to be as accurate as possible when describing products on the Website; however to the extent permitted by applicable law, Natures Wisdom does not warrant that the product descriptions or other content available on the Website are accurate, reliable, current or error free.

Placing an Order and Order Acceptance

You will be guided through the process of placing an order by a series of simple instructions on the Website.  You will be offered the opportunity to select a delivery option, to review your proposed order and confirm or correct it prior to finally placing your order.  You place your order request for products from the Website by clicking on the Submit button at the end of the on-line order process.  All purchases are subject to bank authorisation prior to processing.  Only authorised purchases will be processed and delivered.  Once you have placed your order, Natures Wisdom will send you an email acknowledgement providing you with the details and value of your order, which has been debited to your credit/debit card.  This does not constitute an order acceptance.

Unless Natures Wisdom have notified you that it does not accept your order or you have cancelled your order in accordance with the cancellation policy set out below your order and the completion of the contract between you and Natures Wisdom will take place when Natures Wisdom have dispatched the products ordered by you.  To cancel your order after it has been dispatched to you, you will need to follow the returns policy and procedure.

Natures Wisdom may not accept your order if:-

1. an item you have ordered is out of stock;
2. authorisation for your payment cannot be obtained;
3. fraudulent activity or violation of the Terms is suspected ;
4. a product or pricing error is identified.

If Natures Wisdom is unable to fulfil your order following an order acknowledgement, you will be contacted by e-mail.

Cancellation of an Order
Occasionally, orders or parts of an order are cancelled by our system for various reasons. Some reasons are:
· Item(s) not available.
· Difficulty in processing payment information.
· Cannot deliver to address provided.
· Duplicate order was placed.
· Cancelled due to a customer request.
If your order is cancelled, you will receive an email to explain the reason for the cancellation.  Your original payment method will be refunded for the appropriate amount.
If you wish to change or cancel your order prior to dispatch you should send an e-mail to orders@bpslogistics.co.uk.
If your products have already been despatched it will not be possible to cancel your order.  In this instance you will have to return your order once received in accordance with the Returns policy
Delivery

Natures Wisdom will deliver the products in accordance with the delivery option selected by you during the order process.  Any delivery timescales quoted to you are indicative only.  Orders may be delivered in one or more parts.  Natures Wisdom does not accept any liability whatsoever for delayed delivery caused by any third party.

Prices and payment methods

All prices indicated for products available via the Website are expressed in Euros and are inclusive of VAT but exclusive of delivery charges.  You will have the option of paying for your products in Euros, US Dollars or Pounds Sterling.  The total cost of your order is the price of the products ordered plus delivery charges. 

You many pay using any of the methods specified in the payment section of the Website.  You confirm that the credit or debit card that is being used is yours.

All credit/debit cardholders are subject to validation checks and authorisation by the card issuer.  If the issuer of your payment card refuses or does not, for any reason, authorise payment to us, whether in advance or subsequent to a payment, Natures Wisdom will not be liable for any delay or non-delivery.

Title to products and risk of loss

The legal ownership of the products will remain with Natures Wisdom until full payment has been made by you and received by Natures Wisdom.  Legal ownership of the products will immediately revert to Natures Wisdom if a refund of the payment is made to you.

Risk in the products will pass to you upon delivery to you.

Acceptance of Products

Upon receipt, you must inspect the products.  You will be deemed to have accepted the products unless you notify us that you have cancelled the order and/or you return the products in accordance with the Returns Policy.  If no such action is taken, Natures Wisdom shall not be obliged to accept any rejection of the products at a later date.  Your statutory rights are not affected.

If you have not received the entire order as detailed in the order confirmation email sent to you when an order is received, you should send an e-mail to contact@my-uk-mail.co.uk

Returns Policy

If for any reason you are not entirely satisfied with the products that you have purchased, you may return any item in its original condition for a full refund within 14 days from delivery provided that you tell us within 7 days after the day on which you received the products that you intend to return the item.

If you return products for reasons other than defects in the products or incorrect delivery, you will be required to arrange and pay for the return of the products to Natures Wisdom.  Natures Wisdom will not accept liability for returned products lost in transit.

If you require a refund Natures Wisdom will refund the price paid by you for the products(exclusive of the initial delivery charge) within 30 days of receiving your notification that you would like to return the products provided that you have returned the products in their original condition to BPS Logistics, Unit 4A, Beechwood, Chineham Business Park, BASINGSTOKE, RG24 8WA within 10 working days of delivery.

If you are returning the products owing to defects or incorrect delivery Natures Wisdom will refund you the price you paid for the products (inclusive of the initial delivery charge) and costs for the return carriage from the original delivery point to BPS Logistics, Unit 4A, Beechwood, Chineham Business Park, BASINGSTOKE, RG24 8WA (provided that you enclose a valid till receipt indicating such costs).

Refunds will only be made against the original credit/debit card used.

You are obliged to exercise all reasonable care to store the cancelled products safely and in appropriate conditions until they are returned to Natures Wisdom. Please note that Natures Wisdom will not accept returned products where the seal has been broken or where it reasonably believes that a product has been used or inappropriately stored.  In such circumstances, Natures Wisdom will notify you that no refund will be available and you will be responsible for arranging for such products to be returned to you within 28 days of our notification. Your statutory rights remain unaffected. 

Your Account

You warrant that the personal information which you are required to provide when you register as a customer is true, accurate and current in all respects.  You are responsible for ensuring that the personal information you provide to us is up to date.

You are responsible for maintaining the confidentiality of your account and password and for taking all reasonable measures to prevent unauthorised access to your account.  You agree to accept responsibility for all activities that occur under your account or password.

We reserve the right to refuse service and/or terminate accounts without prior notice if you violate these Terms.

Privacy Policy

Natures Wisdom is registered to collect and process data under the UK Data Protection Act 1998.  Natures Wisdom will deal with any personal information that you provide when you use the Website in accordance with the provisions of UK data law protection.

Natures Wisdom will not provide your personally identifiable information to third parties for their use in marketing their products or services to you without your consent.

Natures Wisdom may disclose any information, including personally identifiable information, it deems necessary, in its sole discretion, to comply with any applicable law, regulation, legal process or governmental request.  Natures Wisdom may also exchange information, including personally identifiable information, with other companies and organisations for credit fraud protection and risk reduction.  Natures Wisdom may retain other companies and individuals to perform functions consistent with its privacy policy for example web hosting companies, credit card processing companies, fulfilment companies (e.g., companies that fill product orders or coordinate mailings).  Such third parties may be provided with access to personally identifiable information needed to perform their functions, but may not use such information for any other purpose.

Limited Licence

Natures Wisdom grants you a limited, revocable, and non-exclusive licence to

1. access and make personal , non-commercial use of the Website
2. create a hyperlink to the home page of the Website for personal, non-commercial use only -

No other use of the information is authorised.  Natures Wisdom may, in its sole discretion, request that you remove any link to the Website, and upon receipt of such request, you shall immediately remove such link.  Any unauthorised use by you of the Website terminates the limited licence set forth in these Terms without prejudice to any other remedy provided by applicable law.

Your Obligations and Responsibilities

In accessing or using the Website, you shall comply with these Terms and the special warnings or instructions for access or use posted on the Website.  You shall act always in accordance with the law, custom and in good faith.  You may not make any change or alteration to the Website or any Content that may appear on the Website and may not impair in any way the integrity or operation of the Website.  Without limiting the generality of any other provision of these Terms, if you default negligently or wilfully in any of the obligations set forth in these Terms you shall be liable for all the losses and damages that this may cause to Natures Wisdom, its affiliates, partners or licensors.

These linked websites are provided solely as a convenience to our visitors are not an endorsement by Natures Wisdom, its affiliates or partners of the referenced content, product, service, or supplier.  Access to any other website linked to the Website is at the user’s own risk and Natures Wisdom is not responsible for the accuracy or reliability of any information, data, opinions, advice or statements made on these websites.  Your linking to any other website is at your own risk.  You should review the terms and conditions of use and the privacy policies of all third party websites that you visit.

Communications transmitted to the Website

Indemnification

You agree to defend, indemnify and hold Natures Wisdom harmless for any loss, damages or costs, including reasonable legal fees, resulting from any third party claim, action, or demand resulting from your use of the Website.  You also agree to indemnify Natures Wisdom for any loss, damages, or costs, including reasonable legal fees, resulting from your use of software robots, spiders, crawlers, or similar data gathering and extraction tools, or any other action you take that imposes an unreasonable burden or load on our infrastructure.

Disputes

Your use of this Website and any purchase by you of any products from Natures Wisdom shall be governed by English law and the parties hereto submit to the exclusive jurisdiction of the English courts

Termination

Natures Wisdom may, with or without prior notice, terminate any of the rights granted by these Terms.  You shall comply immediately with any termination or other notice, including, as applicable, by ceasing all use of the Website.

Severability

If any provision of these Terms shall be held unlawful, void or unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

General

You acknowledge and agree that these Terms constitute the complete and exclusive agreement between Natures Wisdom and you concerning your use of or purchases on the Website, and supersede and govern all prior proposals, agreements, or other communications.
